These Terms & Conditions ("Terms") govern all quotes, orders, and work carried out by Fusion Print Studio ("we", "us", "our"), South Africa, for any customer ("you", "the customer"). By requesting a quote, placing an order, or making payment, you agree to these Terms.
Fusion Print Studio operates as a sole proprietorship and is not currently registered for VAT. No VAT is charged on any quote, invoice, or order.
1. Quotes & Orders
- All quotes are valid for 14 days from the date issued unless otherwise stated.
- Quotes are based on the information, artwork, and quantities provided at the time. Changes to any of these may require a revised quote.
- An order is only confirmed once you accept the quote in writing (including WhatsApp or email) and, where required, pay the deposit set out in Section 2.
- We reserve the right to decline any order, including artwork or requests that are illegal, infringe on third-party rights, or that we are not equipped to produce to an acceptable standard.
2. Pricing & Payment
- All prices are quoted in South African Rand (ZAR). As Fusion Print Studio is not VAT registered, no VAT is added to any quote or invoice.
- A non-refundable deposit may be required before production begins, particularly for custom or large orders. For large orders, a deposit of 70% of the total order value is required before production begins, with the balance due before collection or dispatch. The deposit amount will be confirmed at the time of quoting.
- Full payment is due before collection or dispatch unless alternative payment terms have been agreed to in writing.
- We accept EFT and other payment methods as advised at the time of ordering. Banking details will be provided on your invoice.
- Late payment on agreed credit terms may incur additional charges and may result in future orders being placed on a prepayment basis.
3. Turnaround & Delivery
- Estimated turnaround times are provided at the time of quoting and begin once full artwork, payment (where required), and order details have been received — not from the date of enquiry.
- As a general guide, most orders are completed within 3-4 working days, depending on the process, quantity, and complexity of the order. Larger or more complex orders may take longer, and this will be confirmed at the time of quoting.
- Turnaround times are estimates, not guarantees. We will communicate proactively if a delay is expected, but we are not liable for losses arising from delays outside our reasonable control (including but not limited to courier delays, load shedding, equipment failure, or supplier stock shortages).
- Local collection and courier delivery are both available. Courier costs and risk of loss or damage in transit are the customer's responsibility once the order has left our studio, unless otherwise agreed.
- Orders not collected within 30 days of notification of completion may incur storage fees or be forfeited, at our discretion, without refund.
4. Artwork, Design & Intellectual Property
- You are responsible for ensuring that any artwork, logos, images, or text you supply do not infringe on any third party's copyright, trademark, or other intellectual property rights.
- By submitting artwork for production, you confirm you have the right to use and reproduce it, and you indemnify Fusion Print Studio against any claim arising from artwork you supplied.
- Where we create original artwork or design work on your behalf, ownership of that design remains with Fusion Print Studio unless full payment has been received and a transfer of rights has been agreed to in writing.
- We may photograph finished work for our own portfolio, website, and social media unless you request otherwise in writing before the order is completed.
5. Proofs & Accuracy
- Where a digital proof or mock-up is provided, it is the customer's responsibility to check spelling, colours, sizing, and layout carefully before approving production.
- Once a proof has been approved in writing, we are not liable for errors that were present in the approved proof.
- Minor variations in colour between a digital proof/screen and the final printed or produced item may occur due to differences between digital displays and physical print processes (sublimation, DTF, UV DTF, and large format in particular), and do not constitute a defect.
6. Cancellations & Refunds
- Orders may be cancelled before production begins, subject to forfeiture of any deposit paid to cover work already done (such as design, proofing, or material preparation).
- Once production has started, orders cannot be cancelled, as materials and machine time are process-specific and generally cannot be reused.
- Custom, personalised, or made-to-order items (which make up the majority of our work) are not eligible for return or refund once produced correctly to the approved specification, in line with standard practice for bespoke goods.
- Where an item is faulty or does not match the approved proof due to an error on our part, we will repair, reprint, or refund the affected item at our discretion.
7. Warranty & Liability
- We take reasonable care in the production of all items, using industry-standard materials and processes across 3D printing, sublimation, DTF, UV DTF, and large format printing.
- Products are supplied as-is for their general intended purpose. We do not warrant fitness for any specialised or unusual purpose not disclosed to us in writing at the time of quoting.
- 3D printed items are functional prototypes/parts unless otherwise agreed, and may not be suitable for high-stress, safety-critical, or load-bearing applications unless explicitly discussed and confirmed with us in advance.
- To the maximum extent permitted by law, our liability for any claim arising from an order is limited to the value of that order. We are not liable for indirect, consequential, or special damages, including loss of profit or business opportunity.
- Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008 that cannot lawfully be excluded.
8. Care Instructions
- Sublimation and DTF printed apparel should be washed inside-out, in cold water, and air-dried where possible to maximise print longevity.
- UV DTF decals are designed for external hard surfaces but should not be exposed to abrasive cleaning or prolonged submersion.
- Large format prints intended for outdoor use are durable but not indestructible — expected lifespan will be discussed based on the specific product and application at the time of quoting.
- We are not liable for damage resulting from incorrect care, installation, or use outside the product's intended purpose.
9. Confidentiality
Any personal or business information you share with us in the course of an order (contact details, designs, business information) will be used only for the purpose of fulfilling your order and will not be shared with third parties except where necessary to complete that order (e.g. a courier).
10. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time you place an order will apply to that order.
11. Governing Law
These Terms are governed by the laws of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
